01Who we are and what this covers
Stray turns what you know into a voice agent, a “Stray” - that answers questions at a web link and, on paid plans, at a phone number. These terms cover strays.ai, agent.strays.ai, every Stray hosted on the platform, and anything else we offer under the Stray name (together, the “Service”). “We” and “us” mean the operator named at the top of this page.
By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you use Stray for a business, you agree on that business’s behalf and you confirm you’re allowed to.
02Your account
- You sign in with Google (or Apple, where offered) or with an email address and password. Keep your password private; you’re responsible for what happens under your account. Tell us right away if you think someone else has gotten in.
- You must be at least 16 to open an account (older if the law where you live requires it) and at least 18 to buy a paid plan. Stray isn’t for children.
- Give us accurate information and keep the notification email on your Strays current, that’s where transcripts and messages go.
03Your knowledge and content
To build a Stray you give it “knowledge”: text you paste, files you upload, links you share, plus its name, greeting, and any corrections you teach it. This is your content.
- You own it. We claim no ownership of anything you upload or of the conversations your Stray has.
- You give us a license to use it to run the Service. That means hosting, copying, processing, transforming, transmitting, and displaying it as needed, including generating your Stray’s persona and answers with AI, transcribing and summarizing its conversations, and passing it to the providers listed in our Privacy Policy. The license lasts as long as the content is on Stray and ends when you delete it, apart from backup copies that age out on their own schedule and records we must keep by law.
- You promise you have the right to share it. Don’t upload content you don’t own or have permission to use, other people’s private information without their consent, or anything on the prohibited list below.
- We may run automated checks (such as OpenAI’s moderation tools) on uploaded knowledge and refuse or remove content that fails them.
- Your Stray speaks from what you give it. What it says is, in effect, your speech. You’re responsible for it, so keep your knowledge accurate and up to date.
04Conversations, transcripts, and messages
- Every conversation with a Stray, on the web or by phone, is recorded as a text transcript and summarized by AI. Transcripts and summaries live in your dashboard and, if you turn it on, are emailed to you. Stray does not store audio recordings. Callers can also leave a message (their name, how to reach them, and what it’s about); we store it and email it to you.
- Every Stray says it’s an AI at the start of a conversation. You can’t turn this off or make a Stray pretend to be a person.
- Recording and transcription laws vary. In some places everyone on a call must be told, or must agree, that the call is being recorded or transcribed. It’s your Stray talking to your callers, so you’re responsible for making sure its greeting and your other disclosures meet the rules where you and your callers are (for example by adding a line to its greeting in settings). If you’re unsure, ask a lawyer before you put a Stray on a phone line.
- Callers’ details are shared with you, the owner. Use them lawfully. Don’t add people to marketing lists without a lawful basis for it.
05Phone numbers
- On paid plans, we provision phone numbers through Twilio and attach them to your Stray. A number is yours to use while your plan is active and the number is assigned; it isn’t your property, and we can’t promise you’ll keep a specific number or be able to port it elsewhere.
- If your plan lapses or you remove the number, it goes into a short grace period and is then released.
- Strays answer inbound calls only. Don’t use Stray for outbound dialing, robocalls, or bulk calling of any kind.
- Not for emergencies. A Stray cannot call or route to 911, 112, 999, or any other emergency service, and cannot dispatch help. Never present a Stray’s number as an emergency line.
06What AI can and can’t do
- A Stray answers only from the knowledge you gave it and says “I don’t know” when the answer isn’t there, but it is still AI. It can misunderstand a caller, mis-hear a name, or phrase something wrong. Read your transcripts.
- Nothing a Stray says is professional advice. If your knowledge includes medical, legal, financial, or similar information, you’re the one deciding it’s appropriate to share, and callers should confirm anything important with a person.
- Don’t rely on a Stray for anything where a mistake could hurt someone, emergency triage, safety-critical instructions, decisions with legal effect, without a human in the loop.
07Acceptable use
Don’t use Stray to:
- break the law, or help anyone else break it;
- harass, threaten, defraud, or deceive people;
- impersonate a real person or organization without their authorization, a Stray that speaks for you or your business is the point; a Stray that pretends to be someone else is not;
- send spam, place robocalls, or make unsolicited marketing calls;
- upload content that sexualizes minors, that incites violence, or that infringes someone’s intellectual property or privacy;
- try to reach other owners’ data, probe or overload the Service, reverse-engineer it, or evade limits and safety features (including the AI disclosure and the moderation gate);
- resell or sublicense the Service without our written permission.
We may take down content, pause a Stray, or close an account that breaks these rules, with notice when we reasonably can, immediately when we can’t.
08Plans, minutes, and payment
- Usage is measured in minutes of conversation, web and phone, per Stray, per calendar month. The free tier includes a set number of minutes; when they run out, that Stray stops taking calls until the month resets or you upgrade.
- Paid plans (coming) add minutes and phone numbers and are billed through Stripe. Prices, included minutes, and what happens when you go over are shown when you choose a plan; by buying one you agree to those details too. Plans renew automatically until you cancel. Canceling stops the next renewal; it doesn’t refund the current period unless the law where you live requires it.
- We may change prices or limits. If a change affects a plan you’re paying for, we’ll tell you at least 30 days before it takes effect.
- Prices don’t include taxes unless we say so.
09Refunds
- Monthly plans. Cancel any time from your account, no email required. Your Stray keeps working to the end of the period you already paid for, and nothing renews after that. We don’t refund part of a month.
- Annual plans, first 30 days. Email legal@strays.ai within 30 days of your first annual payment and we refund it in full. No questions, no conditions, and it doesn’t matter how much you used.
- Annual plans after 30 days. We credit whole unused months to your account. The credit works on any plan, add-on, or service we offer; it isn’t paid back as cash.
- Minutes past your plan aren’t refundable. Those calls happened and we paid for them, so we can’t give that money back.
- Add-ons, extra Strays, extra numbers and the like - follow whatever plan they sit on.
- Setup and other one-off work. Refunded in full any time before we start. Once it’s delivered it isn’t refundable, unless we didn’t deliver what we agreed, in which case you get all of it back.
- Phone numbers are released when a refund or cancellation goes through, after the grace window. If you brought your own number, it stays yours, tell us and we’ll help you move it.
- Nothing here reduces a refund right the law where you live already gives you.
10Ending things
- You can pause or delete a Stray any time from its settings page. Deleting takes it offline immediately. You can close your whole account from your account page in the dashboard, or by emailing legal@strays.ai; either way it’s deleted within 30 days.
- We may suspend or terminate your access if you break these terms, if we must for legal or safety reasons, if a paid plan goes unpaid, or - for free accounts, after a long stretch of inactivity, with email notice first.
- We may change or discontinue parts of the Service. If we ever shut it all down, we’ll give reasonable notice and a way to get your data out.
- When your account ends, your Strays stop answering, numbers are released, and your data is handled as described in the Privacy Policy.
11Our stuff
- The Service, its software, design, the Stray name and mascot, the voice presets, and everything else that isn’t your content - belongs to us or our licensors. You get a limited, revocable, non-exclusive license to use it as these terms allow. Don’t copy, scrape, or reuse it beyond that.
- If you send us ideas or feedback, we can use them freely with no obligation to you.
12Disclaimers
Stray is provided “as is” and “as available.” We’re a small, young service and we work hard to keep it running, but we don’t promise it will be uninterrupted, error-free, or fit for a particular purpose, or that a Stray will answer every question correctly. Our providers (OpenAI, Twilio, and the rest) can have outages we don’t control. To the fullest extent the law allows, we disclaim all warranties, express or implied.
13Limits on our liability
To the fullest extent the law allows: we aren’t liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service, even if we’ve been told they were possible. Our total liability for anything arising out of these terms or the Service is capped at the greater of the amount you paid us in the 12 months before the claim or US $100. Some places don’t allow these limits, so they may not fully apply to you.
14Your responsibility for your Stray
If someone brings a claim against us because of your content, your Stray’s conversations (including claims about call recording or disclosures), or your breach of these terms, you’ll defend us and cover the resulting costs, including reasonable legal fees. We’ll tell you promptly and cooperate with you.
15Changes to these terms
We’ll update these terms as Stray grows. When we do, we’ll post the new version here and change the date at the top; for material changes we’ll also email account holders before they take effect. Using Stray after that date means you accept the new terms. If you don’t, stop using the Service and delete your account.
16Governing law and disputes
These terms are governed by the laws of the United States, without regard to conflict-of-law rules. If we have a dispute, we’d both rather talk first, email us and we’ll try to sort it out within 30 days. If that fails, disputes go to the state or federal courts of the United States, and you and we both consent to their jurisdiction. Nothing here takes away rights that consumer law gives you where you live and that can’t be waived.
17The fine print
- These terms and the Privacy Policy are the whole agreement between us about the Service.
- If part of these terms turns out to be unenforceable, the rest still applies.
- If we don’t enforce something right away, we’re not giving up the right to later.
- You can’t transfer your account or these terms to someone else without our okay. We may assign them as part of a merger, sale, or reorganization, and we’ll tell you if we do.
- We’ll send notices to your account email. You can send notices to the contact address below.
